1. Who you are contracting with
Quotiva is operated by Retty iim Rachmani ("we", "us"). By creating an account or using the service you enter into an agreement with Retty iim Rachmani.
2. Acceptance
By continuing to access or use Quotiva you agree to these terms. If you do not agree, stop using the service. If you use Quotiva on behalf of a business, you confirm you have authority to bind that business. Individuals must be of legal age.
3. The service
Quotiva is a web application for solo contractors to create estimates, track change orders, and turn approved work into invoices. It is not accounting software and does not replace your bookkeeping system.
4. Your account
You must provide accurate account information and keep it current. You are responsible for keeping your login credentials confidential and for all activity under your account.
5. Acceptable use
You must not misuse the service. In particular you must not: use it unlawfully; use it for fraud or spam; infringe anyone's intellectual property; upload malware; probe, scan, or interfere with the security of the service; scrape or reverse engineer it; resell or redistribute access; or circumvent technical limits of your plan.
6. Your content
You keep ownership of the jobs, documents, and files you upload. You grant us a limited licence to host and process that content solely to provide the service to you.
7. Intellectual property
We retain all ownership of Quotiva, including its software, documentation, and branding. You receive a limited, non-exclusive, non-transferable right to use the service under your selected plan.
8. Service level
We work to keep Quotiva available, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Payment and subscription terms
The subscription is billed at $19 per month. Payment, billing, tax, cancellation, and refund mechanics are handled by Paddle and governed by the Paddle Buyer Terms. You can cancel at any time; access continues until the end of the paid period.
10. Reseller / Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
11. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination you may export your data for 30 days, after which it may be deleted.
12. Liability
Our aggregate liability is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing limits liability for fraud, death, or personal injury where the law does not permit it.
13. Indemnity
You indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.
14. General
These terms are governed by the laws of the jurisdiction in which Retty iim Rachmani is established, and disputes are subject to its courts. You may not assign this agreement without our consent; we may assign it in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control.
